The Road Accident Fund p​rovid​​es ​​compu​l​s​or​y c​over for injuries sustained or death caused by accidents in​volving motor vehicl​es. This applies to​ all users of S​outh African roads, c​i​tizens and foreigners alike.

This cover is in the form of indemnit​y​ insu​r​an​c​​​e to persons​ w​ho caused the accident, as​ we​ll as personal in​jury and death insurance to victims of motor ve​hicle accidents a​nd the​​ir f​amilies. ​These claims are regulated by the  Road Accident Fund Act (RAF).

What Can I Claim For?

  • General damages for pain, suffering and loss of amenities of life.
  • Loss of financial support by the dependents of the deceased.
  • Hospital and medical expenses, including any future medical expenses as determined by a medical practitioner.
  • Loss of income including past and future loss of earnings as a result of injuries.
  • Funeral costs.

NOTE: RAF does not cover damages to motor vehicles. Such claims are covered by motor vehicle insurance.

Who Can Claim?

Anyone involved in a car accident can claim from the RAF. This includes drivers, passengers and pedestrians. The dependents of a deceased person can also claim. If they are minors, they claim with the assistance of a parent or legal guardian.

However, only serious injuries are covered. The level of seriousness of the injury must be determined by a medical practitioner. He or she will determine if you have suffered any of the following:

  1. Whole Person Impairment

This is permanent damage to any part of your body. The injury is considered serious if it caused 30% or more impairment of your entire body.

2. Permanent Disability

This is a long-term loss of bodily function including permanent disfigurement, long-term mental or behavioral impairment. This also includes the loss of an unborn baby.
