The simple answer is yes. Much like physically walking into a store, you are entitled to get a refund or to return goods you buy online.

What are the seller’s responsibilities?

The seller is required to provide you with essential information on the website, including their full name and  physical address. The seller must also give you an adequate description of the goods or services they are offering you. This includes the price for the goods or services and the terms of the agreement of sale.

When can I cancel an online purchase?

If the seller does not provide the above details, you have the right to cancel the online purchase within 14 days of purchasing.

You have the right to receive goods which are of good quality. You can take legal action against the online seller, distributor or the manufacturer if you suffer harm as a result of the goods being unsafe, or having a product failure or being defective or hazardous.

Therefore, you have the right to:

  1. request a replacement for the goods.
  2. request for the goods to be repaired.
  3. or request a refund.

You also have the right to cancel an online purchase within 7 days of receiving the goods or services without reason. The seller cannot make you pay or penalise you for cancelling within this period. However, your rights to cancel online purchases do not apply to transactions that were for financial services, online auctions, food and consumables or goods that have been personalised.

When Can I Get A Refund?

When you cancel an online purchase, the seller must refund you the amount you paid within 6 months from the date of delivery.

However,  the goods must be in their original packaging and in good condition. Additionally, the seller may charge you for the cost of returning the goods such as shipping.

Online purchases are regulated by the  Consumer Protection Act (CPA), Electronic Communications Act (ECTA) and Protection of Personal Information Act (POPI).
